For nearly ten years in Massachusetts texting while driving has been illegal.
There are similar laws in nearly at 50 states in this country, according to the Insurance Institute for Highway Safety (IIHS). To drive legally in Massachusetts, every driver should refrain from reading, sending or otherwise operating their cell phone to engage with a text message, e-mail, or other communication.
This is not only limited to when the vehicle is in motion. If the vehicle is on, yet stopped, the driver is still deemed to be “driving” and operating the motor vehicle.
