Among all types of personal injuries, burn injuries are among the most painful. A recent article from the National Law Review looks at what victims of burn injury cases go though and some of the things they can do to help ease pain and suffering.

While an overall statistic like this tells the story on a large scale, it does not capture the personal journey each burn victim goes through during the accident and the recovery, if they were able to survive. According to recent news form WRAL, authorities arrested a 25-year-old woman who was working at daycare facility. Police charged her with intentional child abuse involving the infliction of serious physical injury. Specifically, she is alleged to have broken the arm of a one-year-old child this past November.

They believe the same defendant injured their child two months before this most recent incident. In that first incident, family members say their child came home with serious scratches on her back. The defendant had written an incident report in which she claimed that another child had become very excited and scratched their daughter on the back. However, child’s family does not believe another child could have scratched their daughter in such a manner. Continue reading

There is no question that driving in the ice and snow is dangerous. There are many accidents as a result of people driving too fast for dangerous conditions. There are also accidents caused by people in cars that are unable to drive safety in the snow, and there are accidents caused by people being overconfident in vehicles that are designed to handle winter conditions like an SUV with four-wheel drive.

When a victim is injured as result of the negligence of an employee of the state or municipal government, and a lawsuit is filed, government defendants will often try to escape liability or limit liability based on what is known as the doctrine of sovereign immunity. While the actual statute may have a different name under state or local government tort claims acts, the doctrine essentially places a limit on the amount of money one can demand or be awarded from a government defendant in many situations.

The rationale is that a government, unlike a private citizen or corporation, has no choice but to act. The government is responsible for providing various functions. For example, even during a major snowstorm, the government must send out plows and salt trucks. This is dangerous work, and it may result in personal injury or property damage. With winter finally here and much of the East Coast of the Untied States being hit by the recent blizzard, many will be taking to the slopes when they are able to dig out of their homes. According to a recent news report from CBS, a large construction crane fell to the street as it was being lowered from a tall building. As it was being lowered, it somehow broke into pieces, and those large pieces of metal fell to the street below. This was captured on cellphone video taken by someone in another building.

1172422_police_on_the_sceneWhen the crane pieces landed on the street, they crushed several cars, injured three people and killed a Wall Street worker employed at an electronic trading firm. Two of the of three victims who were injured sustained substantial bodily injury as a result of the crane accident. Continue reading

Grammer v. Lucking, a case from the Supreme Court of Nebraska, deals with an injury alleged to have been caused in the course of a dog attack. However, this was not a typical dog bite case in the traditional sense of the term.

When they got to the defendant’s home, they saw that they there were two dogs in the yard. One of the of the dogs was on some type of chain, and the other dog was not on any kind of chain or restraint. There was no fence surrounding defendant’s yard. Continue reading

In Ketler v. PFPA, LLC, a case from the Supreme Court of Delaware, the plaintiff claimed he was injured while working out at fitness center owned by the defendant. Plaintiff claimed that his injuries were caused while using defendant’s fitness equipment and were the result of negligence on behalf of defendant and its employees.

952313_gavelHowever, defendant filed a motion for summary judgment, asking that the case be dismissed. The basis for a motion for summary judgment is essentially that a plaintiff has failed to state a claim for which relief can be granted and that there is no genuine issue of material fact. In other words, defendant is saying that, even if you believe everything plaintiff has claimed in his complaint, defendant is not liable for the injuries allegedly caused to plaintiff. Slip and fall accidents can happen anytime. They can happen in stores when the management negligently fails to clean up a spill or mark the area with a wet floor sign, and they can happen when a tile or section of concrete is left in a state of disrepair that causes someone to trip. However, in the winter we tend to see many more slip and fall accidents occurring outside when someone slips on snow or ice.

In other cases, the city should have plowed better, and in other cases, the accident is to blame on the negligence of a shop or business owner that had a duty to clear the snow and ice in their parking lot, but failed to do so. Burn injuries are among the most serious and painful types of personal injury one could experience. What people may not be aware of is that in addition to the pain and suffering as a result of the damage to the skin and nerves, without the skin to protect the wound, there is a high risk for developing serious and even fatal infections. In fact, secondary infection is one of the major causes of injuries following a serious burn accident.

There are actually four types of burn injuries doctors see in a typical personal injury burn case. A first degree burn is the mildest and is typically caused by the sun and causes redness on the skin. A second degree burn involves damage to the outer layers of skin and can involve blistering and bleeding. A third degree burn involves a burn of all layers of skin, muscle and connective tissue and is extremely painful and has a high risk of infection. The worst type of burn is a fourth degree burn that involves a full thickness burn when even the bone is destroyed by the heat and fire. Continue reading
